Terms of Service

These Terms of Service (the "Terms") set out the conditions on which "Atta?" (the "App") is provided, and the rights and obligations between users (each a "User") and "Kosuke Kaya", the provider of the App ("we", "us" or "our"). By using the App, you are deemed to have agreed to these Terms.

Article 1 (Scope)

These Terms apply to all relationships between Users and us relating to the use of the App.

By downloading, installing or using the App, a User is deemed to have agreed to these Terms.

By using the App, a User represents that they are at least 13 years old (or, where the law of their country, such as an EU/EEA member state, sets a higher age of up to 16, at least that age).

Article 2 (Licence)

Subject to these Terms, we grant Users a non-exclusive, non-transferable right to use the App.

This licence is valid on the following conditions.

That the App is used solely for personal, non-commercial purposes
That all provisions of these Terms are complied with
That applicable laws and regulations are complied with

Article 3 (Prohibited Conduct)

In using the App, Users must not engage in any of the following conduct.

Using the App for unlawful purposes
Interfering with the operation of the App
Decompiling, disassembling or reverse engineering the source code of the App
Modifying, reproducing, distributing, selling, transferring or lending the App
Infringing the rights of third parties (copyright, privacy rights, etc.)
Improperly obtaining or using another person's invitation code or invitation QR code against the intent of the person who issued the invitation
Posting, within a group, content that violates laws or public order and morals, or that defames others
Causing disadvantage to the App or to third parties
Any other conduct that materially interferes with the operation or security of the App

Article 4 (Account Registration)

Using the App requires account registration. You can register with an email address and password, with Sign in with Apple (iPhone app), or with a Google account (Android app). The information received from Google when you sign in with Google is also handled as described in Section 1.1 of our Privacy Policy. If you register with Sign in with Apple, the name and email address received from Apple (a relay address issued by Apple if you choose "Hide My Email") are handled as described in Section 1.1 of our Privacy Policy. Users shall keep their registration information accurate and shall manage their password (or, for Sign in with Apple, their Apple Account; for signing in with Google, their Google account) at their own responsibility. Users are responsible for all activity carried out through their account. If you become aware of any unauthorized use, please contact us promptly.

Article 4-2 (Group Features and Subscriptions)

4-2.1 Group Features

Using the App's "Group" feature lets you share shopping lists, stock and purchase history in real time with family, housemates and others. Content you enter or register in a group (item names, notes, purchase records, display name, etc.) is shared with all members of that group. Users must not register in a group any content that violates laws or infringes the rights of third parties, that contains another person's personal information without their consent, or that violates public order and morals. The User who registered shared content is responsible for that content.

4-2.2 What the Premium Plan Includes

The basic features of the App are free to use. Under the free plan, there are limits on the number of items you can register in a shopping list, the number of stock items you can register, and the period of purchase history you can view (the specific limits are as shown in the App). When you register an account, a group for your own use is created automatically free of charge, and you can use it on the free plan. Inviting other members to a group and creating a second or further group require a subscription to the paid "Atta? Premium" plan. Taking part as an invited member (joining a group through an invitation link or invitation QR code) is free.

Atta? Premium is an auto-renewing monthly or annual subscription sold through the App Store (iPhone app) or Google Play (Android app). The applicable price is the App Store or Google Play price (including tax) shown on the purchase screen within the App. Prices are subject to change.

4-2.3 Billing, Auto-Renewal and Cancellation

Payment is charged upon confirmation of purchase to the User's Apple Account in the iPhone app, or to the User's Google Play account in the Android app.
The subscription automatically renews at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. Renewal is charged within 24 hours prior to the end of the period.
After purchase, you can cancel or manage auto-renewal in "Settings > [your name] > Subscriptions" on your iPhone, or in the Google Play Store app under "Payments & subscriptions > Subscriptions" on Android. Deleting your account does not cancel your subscription.
When a subscription lapses, the features limited to the Premium plan (inviting other members, creating a second or further group, viewing and registering beyond the free plan's limits, hiding advertisements, etc.) become unavailable, but the data you have already registered is not deleted.
Refunds are governed by the terms of service and policies of Apple (iPhone app) or Google Play (Android app). We cannot process refunds directly.

4-2.4 EULA

In addition to these Terms, use of the App, including this subscription, is subject to Apple's standard licence agreement (the Apple Standard EULA). Purchases in the Android app are also subject to the Google Play Terms of Service.

Article 5 (Push Notifications)

The App may send push notifications using Firebase Cloud Messaging in order to inform you of updates to your group's shopping list and similar events. You can change the notification permission at any time in your device (iOS or Android) settings. For how notification data is handled, please see our Privacy Policy.

Article 6 (Data Management and Deletion)

6.1 Data Storage

Shopping lists, stock, purchase history, group information, user names and similar data are stored in a database on Google Cloud (Firebase) under our management, and are shared between the members of the same group. Account information, and data handled by third-party services (Google AdMob, Firebase, RevenueCat and PostHog), are handled as described in our Privacy Policy.

6.2 Automatic Deletion

The App has no automatic data deletion feature. Items and records that have been registered remain stored in the database until the User deletes them manually.

6.3 Manual Deletion

Users can delete items, leave a group, sign out and delete their account through operations within the App. Deleting your account deletes your user information, removes you from the members of the group you belong to, and deletes your authentication account itself. If you cannot use the App, you can ask us as described on the Delete Your Account page. Shopping lists, stock and purchase history remain with the group as its shared data. If you wish the content you registered that remains with the group to be deleted, please contact us at the address given in our Privacy Policy.

6.4 On Uninstallation

Uninstalling the App does not delete the account information, shopping lists, stock, purchase history or group information stored in the cloud. If you want them deleted completely, please delete your account before uninstalling.

6.5 Disclaimer Regarding Data Loss

Data may be lost or corrupted due to communication conditions, server failures, the User's device environment, changes to OS specifications and similar causes. We accept no liability whatsoever for any damage arising from this, except in cases of our wilful misconduct or gross negligence.

Article 7 (Advertising and Analytics)

7.1 Advertising

The App uses Google AdMob to display interstitial and app open (iPhone app only) advertisements (except for subscribers to the Premium plan). It also shows rewarded advertisements, which Users choose to watch themselves, when they use the shopping check beyond the free allowance (three times a day). Displaying advertisements does not incur any additional cost for Users. The content and frequency of advertisements are subject to change without notice.

7.2 Analytics

To find and fix what is hard to use, the iPhone version measures usage with PostHog and, if you consent, records sessions (session replay). What is collected and how to stop it are described in Section 1.10 of our Privacy Policy. The App does not include Firebase Analytics. Diagnostic information that each SDK sends to help identify problems is handled as described in Section 1.8 of our Privacy Policy.

Article 8 (Intellectual Property Rights)

All intellectual property rights relating to the App belong to us or to the third parties that have licensed them to us. The licence to use the App granted under these Terms does not constitute a transfer of any intellectual property rights relating to the App. Users retain their own rights in content such as item names and notes that they register in a group; however, we may use such content to the extent necessary to provide the App (for example, to display it to the members of the same group).

Article 9 (Disclaimers)

9.1 Use of the App

Users use the App at their own responsibility and judgement. We accept no liability whatsoever for any damage suffered by a User in connection with the use of the App, except in cases of our wilful misconduct or gross negligence.

9.2 No Warranty of Accuracy

We make no warranty of any kind as to the accuracy, completeness or usefulness of the shopping lists, stock, purchase history or other records kept by the App. In addition, because the voice input feature uses the speech recognition of Apple (iPhone app) or Google (Android app), errors in recognition and conversion may occur. Suggestions from the shopping check feature are generated by generative AI (Google's Gemini API) and may contain inaccurate or inappropriate content.

Important: The App is a tool to assist with keeping records of your shopping. Please do not rely on it excessively; be sure to verify important information by means other than the App as well.

9.3 Exclusion of Liability for Damages

We accept no liability whatsoever for any damage arising from the use of the App (including, but not limited to, a record not having been kept, a record having been lost, data having been inaccurate, or disadvantage caused by content registered by group members), except in cases of our wilful misconduct or gross negligence.

9.4 Third-Party Services

The App uses third-party services such as Firebase (Google), Google AdMob, RevenueCat and PostHog. We accept no liability for problems arising from failures, specification changes or discontinuation of those services.

Article 10 (Disclaimer of Warranties)

The App is provided "as is". We make no warranty of any kind, including that:

the App will operate without interruption;
the App is free from errors or defects;
the App will work on every device; or
the App is fit for any particular purpose.

Article 11 (Changes to These Terms)

We may change these Terms where we deem it necessary. If we make a significant change, we will give notice by displaying it in the App or by another method we consider appropriate. The amended Terms take effect when they are published on this website. By continuing to use the App after a change to these Terms, a User is deemed to have agreed to the amended Terms.

Article 12 (Governing Law and Jurisdiction)

These Terms shall be interpreted in accordance with the laws of Japan, excluding its conflict of laws principles.

However, consumers residing in the European Union or the United Kingdom may benefit from the mandatory provisions of the law of their country of residence.

Article 13 (Severability)

If any provision of these Terms is held to be invalid, the remaining provisions shall remain in full force and effect.
